The process for opening a new IOLTA account is as follows:
1. Find a financial institution that has been certified as eligible by the IOLTA Committee. Ideally, choose a Leadership Bank to maximize the benefit of your IOLTA dollars, which provide essential funding for civil legal services and access to justice programs in Massachusetts. 2. Download and complete the first section (Attorney Information) of our account opening form called a Notice of Enrollment, found here: https://www.maiolta.org/all-documents/4-iolta-account-opening-form-2022-1/file
3. Take the Notice of Enrollment form to the financial institution you selected and ask them to open a Massachusetts IOLTA account. Have the financial institution complete section two (Financial Institution Information) of the notice of enrollment form, as you will use some of this information to register your account online. Retain a copy of the completed form for your records.
4. Visit our new account registration page and complete the information requested. The online registration page is found here: https://www.maiolta.org/for-attorneys/register-new-account
This new registration process will eliminate unnecessary paper sent to our office and streamline the recording of your new IOLTA account. It is very important that attorneys register each new (not existing) IOLTA account with the IOLTA Committee. We use this information to confirm the account with your financial institution and your participation status under Rule 1.15 of the Massachusetts Rules of Professional Conduct.
